1. Acceptance of Terms
By accessing and using the website tivluxe.com (hereinafter "the Platform"), operated by Tivluxe SpA (Tax ID/RUT: 77.456.789-K), you agree to be bound by these Terms and Conditions. If you do not agree with any of these terms, please refrain from using the Platform. Continued use of the site constitutes acceptance of any subsequent modifications to these terms.
2. Service Description
Tivluxe operates a digital real estate crowdlending platform that facilitates collective investment in construction and urban development projects in Chile. The Platform acts as an intermediary between investors and real estate project promoters, providing information, management tools, and investment tracking. Tivluxe does not guarantee specific returns nor assumes technical management of the listed projects.
3. Requirements for Use
To use Tivluxe's services, you must: be at least 18 years old or have reached the legal age of majority in your jurisdiction; be a resident of Chile or have the legal capacity to invest in Chilean territory; provide truthful, accurate, and complete information when registering or using the contact form; and maintain the confidentiality of your access credentials, if applicable.
4. Investment Risks
Real estate investments through the Platform carry inherent risks. The value of investments can both increase and decrease, and past returns do not guarantee future results. Real estate projects may be affected by market conditions, construction delays, regulatory changes, force majeure events, and other external factors. We recommend consulting with an independent financial advisor before making any investment decision.
5. Intellectual Property
All content on the Platform, including but not limited to texts, graphics, logos, images, software, website design and structure, is the property of Tivluxe SpA or its licensors and is protected by Chilean intellectual property laws and international treaties. Reproduction, distribution, public communication, or transformation of such content without express written authorization is prohibited.
6. Limitation of Liability
Tivluxe provides the Platform and its services "as is" and "as available." To the maximum extent permitted by Chilean law, Tivluxe shall not be liable for: indirect, incidental, special, or consequential damages arising from the use of the Platform; financial losses arising from investment decisions made by users; interruptions or errors in the operation of the Platform; or actions of third parties that affect the outcome of projects.
7. Applicable Law
These Terms and Conditions are governed by the laws of the Republic of Chile. For the resolution of any dispute arising from the use of the Platform, the parties submit to the jurisdiction of the ordinary courts of justice of Santiago, Chile, expressly waiving any other jurisdiction that may correspond to them.
8. Dispute Resolution
In the event of any dispute between Tivluxe and a user, a friendly solution will first be sought through direct negotiation for a period of 30 days. If no agreement is reached, the parties may submit the dispute to mediation before the Arbitration and Mediation Center of the Santiago Chamber of Commerce. If not resolved through mediation, the dispute will be submitted to the jurisdiction of the courts indicated in the previous clause.
9. Modifications
Tivluxe reserves the right to modify these Terms and Conditions at any time. Modifications will take effect from their publication on the Platform. It is the user's responsibility to periodically review these terms. Continued use of the Platform after the publication of modifications constitutes acceptance thereof.
10. General Provisions
If any provision of these Terms and Conditions is declared null or unenforceable, the remaining provisions shall remain in full force and effect. Failure to exercise or delay in exercising any right by Tivluxe shall not constitute a waiver thereof. These Terms and Conditions constitute the complete agreement between you and Tivluxe regarding the use of the Platform.
